AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you and Molly's Mini Farm ("we", "us", "our", "the Farm") regarding your use of our website, purchase of animals, booking of farm visits, events, photography sessions, and all related services. By accessing our website, making a booking, purchasing animals, or visiting our property, you agree to be bound by these Terms.

If you do not agree with these Terms, you may not use our services or visit our property.

1. GENERAL FARM VISITS & EXPERIENCES

1.1 Booking & Reservations
- All farm visits, animal feeding experiences, and tours require advance booking and payment
- Bookings are confirmed only upon receipt of full payment (or required deposit for events)
- We reserve the right to limit the number of guests per visit to ensure animal welfare and quality experience
- Arrival times must be adhered to; late arrivals may result in shortened visit times without refund
- Walk-ins are not permitted without prior arrangement

1.2 Cancellation & Refund Policy - Farm Visits
- Cancellations made 7+ days prior to visit date: Full refund minus 10% processing fee
- Cancellations made 3-6 days prior: 50% refund
- Cancellations made less than 72 hours prior: No refund
- No-shows: No refund
- We reserve the right to cancel or reschedule visits due to weather, animal health concerns, or other circumstances beyond our control. In such cases, you will receive a full refund or option to reschedule
- Refunds will be processed within 10 business days to the original payment method

1.3 Weather Policy
- Farm visits are weather-dependent and primarily outdoor experiences
- In case of severe weather (heavy rain, extreme heat, dangerous conditions), we reserve the right to cancel, reschedule, or modify the experience
- Light rain does not constitute grounds for cancellation by guests; we recommend appropriate attire
- If we cancel due to weather, you may reschedule or receive a full refund

2. BIRTHDAY PARTIES & PRIVATE EVENTS

2.1 Booking Requirements
- Birthday parties and private events require a non-refundable deposit of 50% at time of booking
- Final guest count and balance payment due 7 days prior to event
- Maximum guest capacity will be specified per package and must not be exceeded
- Event duration is limited to the time specified in your package; overtime may incur additional fees

2.2 Cancellation Policy - Events
- Deposits are non-refundable under any circumstances
- Cancellations made 30+ days prior: Refund of payments beyond deposit
- Cancellations made 14-29 days prior: 50% refund of payments beyond deposit
- Cancellations made less than 14 days prior: No refund
- We reserve the right to cancel due to severe weather or emergencies; full refund provided

2.3 Event Conduct
- Host is responsible for the conduct of all guests
- Adult supervision required for all children under 12
- Guests must follow all staff instructions regarding animal interactions
- We reserve the right to end any event early without refund if guests endanger animals, property, or other visitors
- Host is financially responsible for any damage to property caused by guests

3. WEDDINGS & LARGE EVENTS

3.1 Booking & Deposits
- Weddings require a signed contract and non-refundable deposit of $[amount] or 50% of total fee (whichever is greater)
- Deposit due at booking; remaining balance due 30 days prior to event
- All vendor coordination must be approved in advance
- Guest count must be finalized 14 days prior; increases may be accommodated based on availability

3.2 Cancellation Policy - Weddings
- Deposits are non-refundable and non-transferable
- Cancellations made 90+ days prior: Refund of 50% of payments beyond deposit
- Cancellations made 60-89 days prior: Refund of 25% of payments beyond deposit
- Cancellations made less than 60 days prior: No refund

3.3 Wedding Day Terms
- Event time includes setup and breakdown; overtime charged at $[amount]/hour
- Alcohol policy: Alcohol may be made available by us or by you, with written approval from us, through a licensed caterer.
- Vendor access and timing must be coordinated with Farm staff
- Couple is responsible for obtaining any required permits or licenses
- Music must end by agreed upon time
- We reserve the right to end the event if guests endanger animals or violate terms

4. PHOTOGRAPHY SESSIONS

4.1 Booking & Usage
- Professional photography sessions require advance booking and full payment
- Session duration and animal access as specified in package
- Photographers must provide proof of liability insurance
- Commercial photography requires separate licensing agreement

4.2 Photography Rights & Restrictions
- Photographers retain rights to images taken during their session
- We reserve the right to use photos taken on property for marketing purposes unless prior written opt-out provided
- Guests may not enter restricted areas or handle animals without supervision for photo opportunities
- Drones require advance approval and may incur additional fees
- We are not responsible for photo quality or animal cooperation during sessions

4.3 Cancellation Policy - Photography
- Cancellations made 7+ days prior: Full refund minus 10% processing fee
- Cancellations made less than 7 days prior: 50% refund
- Reschedule requests (made 48+ hours in advance): One free reschedule; subsequent changes incur $25 fee

5. ANIMAL SALES

5.1 Purchase Terms
- All animal sales are final; no returns or exchanges
- Deposit of 50% required to hold animal; non-refundable if buyer backs out
- Balance due before animal leaves property
- Buyer responsible for all transportation and associated costs
- We reserve the right to refuse sale to any party

5.2 Health & Genetics
- All animals sold with available health records and vaccination history
- Breeding animals sold with genetic information when available (including chondro status for miniature cattle)
- We make no guarantees regarding future breeding performance, show quality, or temperament beyond what is explicitly stated in writing
- Animals sold "as-is" unless specific health guarantee provided in writing
- Buyer should have animals examined by their own veterinarian within 7 days of purchase

5.3 Health Guarantee (if applicable)
- [Specify your health guarantee terms, e.g., "We guarantee animals are healthy at time of sale. Buyer has 7 days to have animal examined by licensed veterinarian. If serious health condition existed prior to sale (not caused by transport or buyer's care), we will offer replacement animal of equal value or refund, upon return of animal and written veterinary diagnosis."]
- Health guarantee void if: animal not examined within 7 days, animal subjected to stress/illness during transport, or inadequate care provided by buyer

5.4 Registration & Paperwork
- Registration papers (if applicable) transferred within 30 days of full payment
- Any registration fees are buyer's responsibility unless otherwise agreed in writing
- We are not responsible for delays in breed association processing

6. ASSUMPTION OF RISK & LIABILITY

6.1 Inherent Risks
BY VISITING MOLLY'S MINI FARM OR PARTICIPATING IN ANY ACTIVITIES, YOU ACKNOWLEDGE AND ACCEPT THAT:
- Farms contain inherent risks including but not limited to: animal behavior, uneven terrain, weather exposure, insects, allergens, and agricultural equipment
- Animals are living creatures whose behavior cannot be completely predicted or controlled
- Injuries can occur from animal interactions including bites, kicks, scratches, trampling, or allergic reactions
- Property contains natural hazards including but not limited to: uneven ground, water features, fencing, gates, and structures
- You are voluntarily assuming all risks associated with your visit

6.2 Waiver of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT MOLLY'S MINI FARM, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INJURIES, DAMAGES, LOSSES, OR CLAIMS ARISING FROM:
- Animal behavior or interactions
- Accidents or injuries occurring on the property
- Allergic reactions or health conditions aggravated by farm environment
- Loss or damage to personal property
- Weather-related incidents
- Any other cause beyond our reasonable control

6.3 Safety Rules & Guest Responsibilities
Guests must:
- Follow all posted signs and staff instructions
- Supervise children at all times; children under 12 must have adult supervision within arm's reach during animal interactions
- Wash hands after animal contact
- Wear closed-toe shoes; no sandals or flip-flops permitted
- Not bring outside food for animals without permission
- Not enter restricted areas or animal enclosures without staff
- Disclose any allergies or health conditions that may be affected by farm environment
- Remain sober; intoxicated guests will be asked to leave without refund

6.4 Minors
- Parents/guardians of minors accept full responsibility and liability for their children
- Minors must be supervised at all times
- Parents/guardians agree to these Terms on behalf of their children

7. BEHAVIOR & CONDUCT

7.1 Expected Conduct
- Treat all animals with respect and gentleness
- Follow staff instructions at all times
- Keep noise levels appropriate for animals and other guests
- No running, roughhousing, or aggressive behavior
- No smoking or vaping on property
- Service animals welcome; other pets not permitted without prior approval

7.2 Prohibited Actions
- Harassing, chasing, or frightening animals
- Entering animal areas without permission or supervision
- Feeding animals without staff approval
- Damaging property or equipment
- Bringing weapons of any kind
- Use of illegal substances
- Inappropriate language or behavior

7.3 Right to Refuse Service
We reserve the right to:
- Refuse entry or service to anyone
- Remove guests who violate these Terms without refund
- Ban guests who endanger animals, staff, or other visitors
- Terminate events or sessions if Terms are violated

8. INTELLECTUAL PROPERTY & MEDIA

8.1 Our Content
- All content on our website, social media, and marketing materials (including photos, videos, text, logos, and designs) is owned by Molly's Mini Farm or used with permission
- You may not reproduce, distribute, or use our content without written permission

8.2 Guest Media & Consent
- By visiting our Farm, you consent to being photographed or recorded for our marketing purposes
- We may use photos/videos taken on property for social media, website, and promotional materials
- If you do not wish to be photographed, notify staff immediately upon arrival
- Parents/guardians consent to photography of their minor children unless opt-out provided

8.3 Guest-Generated Content
- If you share photos on social media and tag us or use our hashtags, you grant us permission to share your content
- You retain ownership but grant us a non-exclusive, royalty-free license to use your content for marketing

9. GIFT SHOP & MERCHANDISE PURCHASES

9.1 Sales Terms
- All merchandise sales final; no returns or exchanges unless item is defective
- We do not guarantee availability of specific items
- Prices subject to change without notice
- Sales tax applied per California law

10. SEASONAL EVENTS & SPECIAL EXPERIENCES

10.1 Event-Specific Terms
- Seasonal events (e.g., "Cookies & Cocoa with Cows", "Coffee and Cows", etc.) have specific dates, times, and capacities
- These events are subject to the same cancellation policies as general farm visits
- Special dietary accommodations may be requested but cannot be guaranteed
- Event content may vary from marketing materials; we reserve right to modify experiences

11. PROPERTY DAMAGE

11.1 Guest Responsibility
- Guests are financially responsible for any damage to property, animals, equipment, or facilities caused by themselves or their party members
- Damage assessment will be conducted by Farm management
- Repair/replacement costs will be billed to the card on file or invoiced within 7 days
- Failure to pay may result in legal action and ban from property

12. PRIVACY & DATA

12.1 Personal Information
- Use of personal information is governed by our Privacy Policy
- By using our services, you consent to our Privacy Policy
- We collect information necessary to provide services and communicate with you

13. MODIFICATIONS TO SERVICES

13.1 Right to Modify
We reserve the right to:
- Modify services, packages, or pricing at any time
- Substitute animals for experiences due to health, safety, or availability
- Change operating hours or seasonal schedules
- Close temporarily or permanently with reasonable notice
- Modify these Terms at any time; continued use constitutes acceptance

14. FORCE MAJEURE

14.1 Unforeseeable Circumstances
We are not liable for failure to perform obligations due to:
- Severe weather or natural disasters
- Disease outbreaks affecting animals or humans
- Government orders or restrictions
- Acts of God
- Other circumstances beyond our reasonable control

In such cases, we will offer reschedule options or refunds at our discretion.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Molly's Mini Farm, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or rights of third parties
- Your use of our services or visit to our property
- Your actions or those of anyone in your party

16. DISPUTE RESOLUTION

16.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.

16.2 Jurisdiction
Any disputes shall be resolved in the courts of Placer County, California.

16.3 Informal Resolution
We encourage you to contact us first to resolve any disputes informally. Many concerns can be addressed through good-faith communication.

17. MISCELLANEOUS

17.1 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Molly's Mini Farm.

17.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver
Our failure to enforce any provision does not waive our right to enforce it later.

17.4 No Partnership
Nothing in these Terms creates a partnership, agency, or employment relationship.

17.5 Assignment
You may not assign these Terms; we may assign them without notice.

18. ACKNOWLEDGMENT

BY USING OUR WEBSITE, BOOKING SERVICES, PURCHASING ANIMALS, OR VISITING MOLLY'S MINI FARM, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You accept all risks associated with farm visits and animal interactions
- You waive certain legal rights as outlined herein
- You are at least 18 years old or have parental/guardian consent
